By downloading, accessing, or using the Dog Whistler mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use our App.

The App is rated 4+ and is suitable for all ages. However, adult supervision is recommended when the app is used by children.

2. Description of Service

Dog Whistler is a dog training application for iOS that includes:

• Dog Whistle: High-frequency sound generator (0-22kHz) with adjustable frequency
• Training Sounds: Clicker and other training audio for positive reinforcement
• Voice Commands: Recording feature for personalized voice commands
• Training Modules: Step-by-step guides for teaching commands (Sit, Stay, Come, etc.)
• Progress Tracking: Session history and visual charts
• Dog Profiles: Create and manage profiles for your dogs

The App operates primarily offline, with all data stored locally on your device. We do not collect personal information from users.

3. Free and Premium Features

3.1 Free Features

The free version of Dog Whistler includes:

• Basic dog whistle (18-22kHz adjustable)
• 1 saved whistle preset
• Basic clicker sound
• 1 dog profile
• 3 voice command recordings
• 3 training modules (Sit, Stay, Come)
• 10 training sessions
• 7-day session history chart

3.2 Premium Features

Premium features are available through a one-time in-app purchase of $9.99 USD:

• Full frequency range (0-22kHz with logarithmic control)
• 10+ custom whistle presets
• Pro clicker with multiple sound options
• Unlimited dog profiles
• Unlimited voice command recordings
• 20+ training modules (including advanced techniques)
• Unlimited training sessions
• Advanced analytics and charts
• Export data to PDF/CSV
• Training reminders and notifications

The Premium upgrade is a one-time, non-consumable purchase. No subscription or recurring charges apply.

3.3 No Account Required

Dog Whistler does not require user accounts or registration. All data is stored locally on your device. Your Premium purchase is tied to your Apple ID and can be restored on any device signed into the same Apple ID.

4. Audio Safety and Usage Guidelines

Important: High-frequency sounds can affect dogs and humans. Please use responsibly:

• Start with lower volumes and gradually increase as needed
• Do not use the whistle continuously for extended periods
• Stop immediately if your dog shows signs of distress (cowering, whining, running away)
• Keep the speaker away from ears when testing frequencies
• Audio stops on background: For safety, the whistle automatically stops when the app goes to background
• Consult a veterinarian if you have concerns about your dog's hearing or reaction to sounds

We are not responsible for improper use of the high-frequency sounds. Use common sense and prioritize your dog's wellbeing.

5. User Data and Content

Dog Whistler operates with local storage:

• Dog Profiles: Created and stored on your device
• Voice Recordings: Recorded using your microphone and stored locally
• Training Data: Session history stored on your device
• Whistle Presets: Saved frequency settings stored locally

You are responsible for the content you create (voice recordings, dog profile photos). Deleting the app removes all locally stored data. Your Premium purchase can be restored after reinstallation.

6. Prohibited Conduct

You agree not to:

• Use the App to harm, harass, or cause distress to any animal
• Use high-frequency sounds maliciously or to disturb others
• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to circumvent or disable the App's security features or purchase mechanisms
• Share or distribute the App's content outside authorized channels
• Use automated tools or bots to interact with the App
• Violate any applicable local, state, national, or international law

7. Purchases and Payments

7.1 Premium Purchase

The Premium upgrade is processed through Apple's App Store:

• Price: $9.99 USD (or equivalent in your local currency)
• Type: Non-consumable (one-time purchase, no recurring charges)
• Payment: Charged to your Apple ID at confirmation
• Restore: Can be restored on any device signed into the same Apple ID

7.2 Refunds

All sales are processed by Apple. Refund requests should be directed to Apple through the App Store, as we do not process payments directly. Refunds are subject to Apple's refund policy.

7.3 Price Changes

We reserve the right to modify pricing at any time. Price changes will not affect purchases already made.

8. Intellectual Property

The App, including all content, features, functionality, and underlying technology, is owned by us and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not:

• Reproduce, distribute, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any proprietary notices
• Use our trademarks or branding without written permission
• Copy or replicate the training module content

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The App will be uninterrupted, secure, or error-free
• The training methods will be effective for all dogs
• The high-frequency sounds will produce specific results
• The App will meet your specific requirements
• Any errors or defects will be corrected
• The App will be compatible with all devices or operating systems

Dog training results vary based on many factors including breed, age, temperament, consistency, and training environment. The App is a tool to assist training, not a guarantee of results.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Any injury or harm to your pet
• Loss of data from your device
• Any unauthorized access to your recordings or data
• Any interruption or cessation of the App
• Any bugs, viruses, or similar harmful components
• Any third-party claims related to your use of the App

Our total liability to you for all claims arising from your use of the App shall not exceed the amount you paid for Premium features ($9.99 USD maximum).

11. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from:

• Your use or misuse of the App
• Violation of these Terms
• Infringement of any rights of another party
• Any harm caused to animals through misuse of the App
• Content you create (voice recordings, profiles)

12. Termination

These Terms remain in effect until terminated. You may stop using the App at any time by deleting it from your device. We may terminate your access to the App if you violate these Terms.

Upon termination:

• All locally stored data will be deleted when you uninstall the App
• Your Premium purchase remains tied to your Apple ID and can be restored if you reinstall
• These Terms provisions that should survive termination will remain in effect

13. Updates and Modifications

13.1 App Updates

We may periodically update the App to add features, fix bugs, improve performance, or update training content. Updates are delivered through the App Store.

13.2 Terms Updates

We may modify these Terms at any time. We will notify you of significant changes by posting a notice on our website or through the App. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with Polish arbitration rules, except that you may pursue claims in small claims court if they qualify.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
